Negotiating
PBG handles a number of different types of negotiations. With a great deal of experience in commercial negotiating incorporating commercial terms, legal documentation, initial counterparty approach, dissolutions/terminations, roll-overs/extensions, sales and internal staffing matters our competence also encompasses private matters such as sensitive estate settlements (including high profile with media exposure) and family investments and divestments.
There are many reasons why we are engaged as a 3rd party negotiator by our Clients, some of which include:
- Risk transfer of handling the matter;
- Increased comfort by counterparties as a result of arm’s length dealings;
- Leveraging PBG’s high levels of experience;
- Enhanced potential resulting from dispassionate conduct;
- Increased confidence of Client;
- Improved probability of success;
- Perceived or real conflict of interest;
- Lack of resources;
- In-situ and familiarity benefits; and
- Panel approach.
At PBG we manage any portion (whole or part) of the spectrum from familiarisation of Client and in-principle agreement(s) through to preparation and execution of documentation.
Due to the nature of negotiations as a whole, and in light of the confidence we have in our abilities, we offer a ‘costs only guarantee*’ for short-term/short engagement negotiations (* subject to terms and conditions). In other words, if our negotiations are unsuccessful we provide the service fee free. This offer is made and determined by and subject to the sole discretion of PBG.
